Distance Sales Agreement

ARTICLE 1 - SUBJECT

The subject of this contract is the BUYER's property belonging to the SELLER. It is the determination of the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers No. 4077 and the Regulation on Distance Contracts, regarding the sale and delivery of the product or products ordered electronically from the website www.inspiredcocktail.com .

ARTICLE 2 - PARTIES

ARTICLE 3 - GENERAL PROVISIONS

3.1 By confirming the preliminary information electronically, the BUYER/Consumer confirms that he/she has declared the address, basic features of the ordered product(s), the price of the product(s) in Turkish Lira including taxes, payment and delivery information accurately and completely before the conclusion of distance contracts.

3.2 The product subject to this contract will be delivered to the BUYER or the person/organization at the address specified by the BUYER within the period specified in the preliminary information on the website, depending on the distance of the BUYER's residence, provided that the legal 30-day period does not exceed this period. The BUYER acknowledges and declares that the delivery address provided to the SELLER is complete and accurate.

3.3 If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the person/organization to whom the product is to be delivered does not accept the delivery.

3.4 - For the delivery of the contractual product, the price of the product must be paid using the payment method chosen by the BUYER. If, for any reason, the price of the product is not paid or is cancelled in bank records, the SELLER is deemed to be released from its obligation to deliver the product.

3.5 If the SELLER is unable to deliver the contracted product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or transportation interruptions, the SELLER is obligated to notify the BUYER. In such cases, the BUYER may exercise one of the following rights: cancel the order, replace the contracted product with a comparable product, if any, and/or postpone the delivery until the impeding condition is resolved. If the BUYER cancels the order, the amount paid will be refunded in cash and in one lump sum.

3.6 In cases where the BUYER exercises their right of withdrawal, or if the ordered product cannot be supplied for various reasons, or if the arbitration committee decides to refund the price to the Consumer, if the purchase was made by credit card and in installments, the credit card refund procedure is as follows: The Bank may make the refund to the BUYER in installments and in the same number of installments as the BUYER purchased the product. After the SELLER pays the Bank the full product price in a single lump sum, if the installment expenditures made through Bank POS are refunded to the BUYER's credit card, the requested refund amounts may be transferred to the holder's accounts by the Bank in installments to prevent any aggrieved parties. The installment amounts paid by the BUYER up to the date of the sale cancellation will be reflected on the card once each month, unless the refund date and the card statement date coincide. The BUYER will receive the installments paid before the refund for an additional month, equal to the number of installments paid before the refund, and this may be deducted from their existing debts.

3.7 In the event of a return of goods or services purchased with a credit card, the SELLER cannot pay the Customer in cash, as per the agreement it has made with the Bank. Refunds to credit cards can be made by the Bank in accordance with the procedure above, after the SELLER has made a single payment to the Bank.

3.8 In the Money Order/EFT payment options, the refund will be made by money order or EFT to the account specified by the Consumer by requesting the bank account information (the account must be in the name of the person whose name is written on the invoice).

3.9 Shipping fees may apply to some regions where products are shipped. The shipping fee will be paid by the SELLER. The SELLER cannot be held responsible under any name or title for any failure to deliver the ordered product to the BUYER due to any problems encountered by the shipping company during the delivery of the product to the BUYER or other reasons not attributable to the SELLER.

3.10 The SELLER may supply different product(s) of equal quality and price by informing the BUYER and obtaining his/her explicit approval before the expiration of the performance obligation arising from the contract.

3.11 If the BUYER fails to fulfill its payment obligations under this contract in any way, the SELLER may initiate enforcement proceedings, file a debt lawsuit or take other legal action in order to collect the uncollected product price, together with interest to be accrued based on the price of the product on the delivery date and the interest rates stipulated in the contract.

ARTICLE 4 - PERSONAL INFORMATION COLLECTION PROCEDURE

4.3 Your information may only be used for the purposes specified: Processing your orders and managing your account, Marketing our services and related products, Contacting you via email, phone, fax or SMS or postal mail through our representatives for market research purposes, Analysing how you use our website and customising our website for you to better serve you, Creating identity, verification and registration, Researching and improving our products and services and your personal selection possibilities related to them, Introducing our services or related products to you, periodically sending promotional e-mails about new products and other information we think you will find interesting, The data you enter is stored by us for the duration of your transactions and legal requirements.

ARTICLE 5 - DEFAULT EVENT AND LEGAL CONSEQUENCES

5.1 If the BUYER defaults on credit card transactions, the BUYER will pay interest and be liable to the bank in accordance with the credit card agreement it has with the cardholder bank. In such a case, the bank may take legal action and claim any resulting expenses and attorney fees from the BUYER. In any case, if the BUYER defaults on a debt, the BUYER agrees to pay the Seller any losses and damages incurred due to the delayed payment of the debt.

ARTICLE 6 - RIGHT OF WITHDRAWAL

6.1 These types of goods are not subject to return because they are considered separate within the framework of the Regulation on Distance Contracts and, by their nature, expire once consumed. According to Article 7, paragraph 4, subparagraph c, titled "Right of Withdrawal" of the Regulation on Distance Contracts, the consumer cannot exercise their right of withdrawal for goods prepared in accordance with the consumer's wishes or clearly in line with their personal needs.

ARTICLE 7 - ORDER CANCELLATION

7.1 Address and delivery date changes for your orders must be notified at least 12 hours before the delivery time you specified. SELLER is not responsible for any problems that may arise if not notified.

7.2 You can cancel your order before the product is prepared and shipped. (You can track the status of your product using the activation code sent to the email address you provided during your order, or you can contact our call center for information.)

7.3 During the refund process, the SELLER is not responsible for delays due to the rules and operations of the bank to which the credit card information provided by the BUYER is linked.

7.4 Disputes that may arise during your shopping are limited to the order price.

ARTICLE 8 - OTHER PROVISIONS

8.1- Persons under the age of 18 cannot shop from the SELLER.

8.2- SELLER is not responsible for price errors resulting from typesetting and system errors.

ARTICLE 9 - COMPETENT COURT

9.1 In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts in the SELLER's place of residence are authorized up to the value declared by the Ministry of Industry and Trade.
